Federal Court Orders Release of Kilmar Abrego Garcia from Immigration Detention
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement is without legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.
The situation originates in a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. After his return to the United States to face human smuggling charges, he was held in federal detention.
In her order, the judge pointed out that the authorities lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

The court proceedings center on disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.
